In the event of his death or incapacity to act, his relatives or employees should be able to act immediately. This can only be achieved with appropriate powers of attorney.

General power of attorney

This power of attorney enables the authorised representative to perform all acts on behalf of the sick or deceased person or the heirs. Powers of attorney can also be issued for individual, precisely described actions.

Bank power of attorney

The private bank power of attorney serves the financial capacity of the heir to act as long as the legal succession has not been formally established (certificate of inheritance or public will). The power of attorney beyond death can be issued with immediate effect, with effect on death or on formally established legal incapacity. As a rule, banks only accept bank powers of attorney if they are submitted on their forms and in the presence of their employees (or notarised).

Special forms are the provident power of attorney and, in the corporate sector, the shareholder’s power of attorney and the management power of attorney.

Round Table

We rightly talk about these topics in our Round Table meetings. The Round Table is an action of Herfurth & Partner and serves to clarify and secure wishes and decisions in the family in connection with assets, provision and succession.

The next dates can be found in the Round Table section (welcome homepage).

Further information on many topics can be found in the Publications section (welcome homepage).
