The patchwork family

In the patchwork family, the old family splits up – the former spouses enter into relationships with new partners and form a new family. However, the old relationships are not completely cut, but are partially retained and linked to the new family: The children’s contact and stay, alimony for children and old and new spouses, inheritance and compulsory portion claims. After all, the children from earlier marriages belong together with children from the existing marriage to the community of heirs. With divorce agreements, marriage contracts, inheritance contracts and wills, however, the relationships can largely be arranged.

  • Should the spouse receive custody of stepchildren?
  • Should children outside the current marriage be members of the community of heirs?
  • Should the former spouse be the legal representative of the children in the joint heirship with the new spouse?
